1. Agreement to Terms

These Terms of Service govern your access to and use of it3dp.ca and the products and services offered by The Print Shop by iTech, operated by Chris Logan as a sole proprietorship in Morinville, Alberta, Canada.

By accessing the website, creating an account, uploading a file or photograph, placing an order, purchasing a digital download, or otherwise using the services, you agree to these Terms of Service.

If you do not agree to these Terms of Service, you must not use the website or services.

2. Services

The Print Shop by iTech provides Canadian customers with 3D print-on-demand products and related digital services, including:

  • Custom Upload Prints: physical 3D prints manufactured from customer-uploaded 3D model files;
  • Gnomeify AI Figurines: physical figurines generated from customer-uploaded reference photographs using third-party AI services;
  • Digital GLB Downloads: optional digital GLB files associated with eligible Gnomeify orders.

All products are custom-made or digitally generated based on customer inputs and selected configurations.

3. Canadian Customers Only

The services are currently intended for customers located in Canada. We may refuse, cancel, or decline orders from outside Canada.

4. Accounts

You may need to create an account to upload files, generate products, place orders, access order history, or download digital files.

You agree to:

  • Provide accurate and complete account information;
  • Keep your login credentials secure;
  • Promptly update inaccurate account information;
  • Accept responsibility for activity under your account;
  • Notify us immediately if you suspect unauthorized access to your account.

We may suspend or terminate accounts that violate these Terms, misuse the services, submit prohibited content, or create security, legal, operational, or payment risk.

5. Customer Uploads

You are solely responsible for all files, photographs, images, models, content, and other materials you upload or submit through the website.

By uploading content, you represent and warrant that:

  • You own the content or have all necessary rights and permissions to use it;
  • Your upload does not infringe any copyright, trademark, design right, privacy right, publicity right, moral right, or other third-party right;
  • Your upload does not contain unlawful, dangerous, harmful, or prohibited content;
  • Your upload does not contain malware or malicious code;
  • You have permission from any person whose likeness, image, or personal information appears in an uploaded photograph.

6. Licence to Process Customer Uploads

You retain ownership of your uploaded content, subject to the rights you grant below.

By uploading content, you grant The Print Shop by iTech a limited, non-exclusive, worldwide, royalty-free licence to receive, store, copy, process, analyze, modify, convert, transmit, display, and use the uploaded content solely as necessary to:

  • Provide the services;
  • Generate pricing;
  • Prepare files for production;
  • Generate AI images or 3D models;
  • Manufacture your order;
  • Provide previews;
  • Deliver digital downloads;
  • Provide customer support;
  • Maintain records;
  • Detect fraud, misuse, security issues, or prohibited content;
  • Comply with legal obligations.

For Gnomeify orders, this licence includes permission to submit your uploaded photograph or derived outputs to third-party AI service providers for the purpose of generating your requested product.

7. Acceptable Use

You must not upload, order, request, create, or use the services for content that:

  • Is unlawful or promotes unlawful conduct;
  • Infringes intellectual property rights;
  • Violates privacy, publicity, or personality rights;
  • Contains another person’s image without appropriate permission;
  • Is defamatory, abusive, harassing, hateful, discriminatory, or threatening;
  • Is sexually exploitative or involves minors in an inappropriate manner;
  • Contains malware, viruses, or harmful code;
  • Is intended to deceive, impersonate, or misrepresent identity;
  • Is unsafe, dangerous, or intended for use as a weapon;
  • Is intended for load-bearing, medical, automotive, aviation, life-safety, or other safety-critical use without professional engineering review;
  • Violates any platform guideline, law, regulation, or third-party right.

We may refuse, cancel, remove, or decline to produce any upload or order at our discretion if we believe it violates these Terms, creates legal risk, creates safety risk, is technically unsuitable, or is otherwise inappropriate for the services.

8. Supported File Formats and Technical Requirements

Custom upload print orders may support file formats including STL, OBJ, 3MF, and GLB.

We may set or change limits for:

  • File formats;
  • File size;
  • Model dimensions;
  • Geometry complexity;
  • Printability;
  • Materials;
  • Colours;
  • Finish options;
  • Infill settings;
  • Quantity;
  • Daily AI generation usage;
  • Other technical or operational requirements.

We are not responsible for poor results caused by defective, non-manifold, incomplete, improperly scaled, low-resolution, corrupted, unsupported, or unsuitable customer files.

9. Gnomeify AI Figurines

The Gnomeify service allows customers to upload a reference photograph and generate a stylized gnome-themed figurine.

You acknowledge and agree that:

  • Gnomeify uses third-party AI services;
  • AI outputs are probabilistic and may vary;
  • Exact likeness, accuracy, symmetry, colours, proportions, facial resemblance, or artistic outcome are not guaranteed;
  • Generated images and models may contain imperfections or unexpected features;
  • We may impose daily generation limits;
  • We may reject photographs that are unsuitable, unlawful, low quality, technically incompatible, or otherwise inappropriate;
  • Additional attempts, revisions, or regenerations may be limited, charged separately, or unavailable.

By using Gnomeify, you confirm that you have all necessary rights and permissions to upload the photograph and authorize AI processing of the photograph.

10. Product Previews

Product previews, renderings, screenshots, AI outputs, generated models, colours, dimensions, and mockups are estimates only. Actual physical prints may vary due to:

  • Printer calibration;
  • Material properties;
  • Filament colour variation;
  • Layer lines;
  • Support marks;
  • Minor surface imperfections;
  • Shrinkage or warping;
  • Scaling;
  • Model geometry;
  • AI generation variability;
  • Differences between screen display and physical materials.

11. Orders

An order is not accepted until checkout is completed and we confirm the order. We may refuse or cancel any order before production begins if:

  • Payment fails;
  • Fraud or misuse is suspected;
  • The upload violates these Terms;
  • The file is technically unsuitable;
  • The requested item is unsafe, unlawful, or impractical to produce;
  • Pricing, tax, shipping, or availability errors occur;
  • Materials or production capacity are unavailable.

If we cancel an order after payment but before production begins, we will provide a refund unless cancellation is due to fraud, chargeback abuse, prohibited conduct, or another lawful reason to withhold refund.

12. Pricing, Taxes, and Payment

All prices are listed in Canadian dollars unless otherwise stated.

Prices may include or exclude applicable taxes and shipping charges as displayed at checkout. Applicable GST/HST and other taxes may be calculated based on the customer’s shipping address or other relevant information.

Payments are processed through Stripe-hosted checkout. We do not store full credit card numbers or raw payment credentials.

You agree to provide accurate billing, shipping, and payment information. You authorize Stripe and related payment providers to process the payment for your order.

Promotion codes, discounts, and 100%-off orders may be subject to additional conditions, expiry dates, and limits.

13. Production and Fulfillment

Production timelines are estimates only. Actual turnaround may vary based on order volume, file complexity, material availability, printer capacity, AI generation time, quality-control needs, and shipping carrier performance.

Estimated production and delivery-access timelines are as follows:

  • Custom upload prints: approximately 24 hours before production review, preparation, or fulfillment begins;
  • Gnomeify figurines: approximately 48 hours before generation review, production preparation, or fulfillment begins;
  • Digital GLB downloads: available instantly after successful checkout, subject to account authentication and system availability.

These timelines are estimates only and may vary based on order volume, file complexity, material availability, printer capacity, AI generation time, quality-control needs, customer response time, and third-party service availability.

We may contact you if a file is not printable, requires clarification, or cannot be produced as submitted.

14. Shipping

Physical orders are shipped to the address provided at checkout. You are responsible for ensuring that your shipping address is accurate and complete.

Available carrier services may include Canada Post or UPS Ground through Canada Post Parcel or UPS Express Plus or other available services displayed at checkout.

Shipping timelines are estimates only. Once a package is tendered to the carrier, we are not responsible for carrier delays, missed delivery attempts, incorrect addresses, weather delays, customs delays, service interruptions, or other events outside our control.

Risk of loss may transfer to you when the package is delivered to the shipping carrier, to the extent permitted by law.

15. Cancellations

Because products are custom-manufactured, cancellation rights are limited.

You may request cancellation before production begins by contacting hello@it3dp.ca as soon as possible.

Once production, AI generation, file preparation, printing, post-processing, packing, label creation, or fulfillment has begun, cancellation may no longer be available.

If cancellation is approved, any refund will be processed to the original payment method where possible.

16. Returns and Refunds for Physical Products

Physical products are custom-made to order. For that reason, change-of-mind returns, buyer’s remorse returns, and returns based solely on subjective preference may not be accepted.

We may provide a replacement, repair, refund, partial refund, or store credit at our discretion if:

  • The item arrives materially damaged;
  • The wrong item is shipped;
  • The item materially differs from the confirmed order specifications;
  • A manufacturing defect occurred that materially affects ordinary use.

To request support, contact hello@it3dp.ca within 7 days of delivery and include:

  • Order number;
  • Description of the issue;
  • Clear photographs of the item, packaging, and shipping label where applicable.

We may require return of the item before issuing a refund or replacement.

Minor layer lines, support marks, colour variation, small surface imperfections, normal 3D printing artifacts, and differences between previews and finished prints are not defects unless they materially prevent ordinary use of the product.

17. Refunds for Gnomeify AI Outputs

AI-generated products are inherently variable. Dissatisfaction with artistic style, exact likeness, or subjective resemblance does not automatically qualify for a refund once generation or production has begun.

We may, at our discretion, offer one or more of the following:

  • A limited regeneration attempt;
  • A revised model if technically feasible;
  • Store credit;
  • Partial refund;
  • Full refund if production has not begun and the issue cannot reasonably be resolved.

No guarantee is made that any AI-generated output will exactly match the uploaded photograph or customer expectations.

18. Digital GLB Downloads

Eligible customers may purchase a digital GLB file associated with a Gnomeify order.

Digital downloads are delivered through secure, authenticated download links tied to the purchasing account.

Unless otherwise agreed in writing:

  • Digital GLB files are licensed for personal, non-commercial use only;
  • You may not resell, sublicense, redistribute, upload for public download, or commercially exploit the digital file;
  • You may not claim exclusive ownership of AI-generated style, output, or underlying service technology;
  • Commercial use requires a separate written agreement.

Because digital downloads are delivered electronically, digital download purchases are final and non-refundable once access has been provided, except where required by law.

19. Intellectual Property

The website, branding, text, graphics, software, pricing systems, workflows, product configuration systems, and service design are owned by The Print Shop by iTech or its licensors and are protected by applicable intellectual property laws.

You may not copy, reverse engineer, scrape, reproduce, modify, distribute, or create derivative works from the website or services except as expressly permitted by these Terms.

You retain any rights you have in your uploaded files and photographs, subject to the licence granted to us to provide the services.

20. Customer Responsibility for Designs and Use

You are solely responsible for determining whether a printed item is suitable for your intended use.

Unless expressly agreed in writing, products are not certified, tested, or approved for:

  • Load-bearing use;
  • Structural use;
  • Automotive use;
  • Aviation use;
  • Medical use;
  • Food-contact use;
  • Electrical safety use;
  • Child safety use;
  • Life-safety use;
  • Industrial safety use;
  • Any regulated or safety-critical application.

You use printed products at your own risk. You are responsible for obtaining professional engineering, safety, legal, or regulatory advice where appropriate.

21. No Professional Advice

The Print Shop by iTech does not provide engineering, safety, medical, legal, regulatory, or product-certification advice. Any comments about printability, material selection, dimensions, or suitability are general production comments only and should not be relied on as professional advice.

22. Disputes and Chargebacks

If you have an issue with an order, you agree to contact us first at hello@it3dp.ca so we can attempt to resolve the issue.

Payment disputes and chargebacks may be handled through Stripe and the applicable payment network. We reserve the right to provide order records, shipping records, communications, upload records, production records, and delivery evidence to payment processors or dispute-resolution providers as reasonably necessary to respond to a dispute.

23. Service Availability

We do not guarantee uninterrupted or error-free service. The website or services may be unavailable due to maintenance, updates, outages, security issues, third-party service interruptions, AI provider limits, payment processor issues, hosting issues, or other operational reasons.

We may modify, suspend, limit, or discontinue any part of the services at any time.

24. Third-Party Services

The services rely on third-party providers, including authentication, payment, hosting, storage, AI generation, email, tax calculation, and shipping providers.

We are not responsible for third-party service outages, errors, delays, policy changes, pricing changes, data-processing practices, or failures, except to the extent required by law.

Your use of third-party services may be subject to those providers’ own terms and privacy policies.

25. Disclaimer of Warranties

To the maximum extent permitted by law, the website, services, digital files, generated outputs, and physical products are provided “as is” and “as available.”

We disclaim all warranties, conditions, and representations, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, durability, accuracy, availability, and error-free operation.

Some jurisdictions do not allow limitations on certain warranties, so some limitations may not apply to you.

26. Limitation of Liability

To the maximum extent permitted by law, The Print Shop by iTech and its operator will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or aggravated damages, including lost profits, lost revenue, lost data, business interruption, replacement costs, or loss of goodwill.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the website, services, digital files, generated outputs, or physical products will not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

27. Indemnity

You agree to indemnify and hold harmless The Print Shop by iTech and its operator from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

  • Your uploaded content;
  • Your breach of these Terms;
  • Your infringement of third-party rights;
  • Your misuse of the services;
  • Your use of printed products or digital files;
  • Your violation of law;
  • Your unauthorized upload of another person’s image, likeness, model, file, or intellectual property.

28. Privacy

Your use of the website and services is also governed by our Privacy Policy, which explains how we collect, use, disclose, store, and protect personal information.

29. Termination

We may suspend or terminate your access to the website or services at any time if we believe that:

  • You violated these Terms;
  • You uploaded prohibited content;
  • You created legal, safety, security, payment, or operational risk;
  • Your account was used fraudulently or without authorization;
  • We are required to do so by law;
  • Continued access would harm us, another user, a third party, or the services.

Upon termination, your right to use the services will end immediately. Certain provisions of these Terms will survive termination, including payment obligations, intellectual property provisions, disclaimers, limitations of liability, indemnity, governing law, and dispute provisions.

30. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the website with a revised effective date.

Your continued use of the website or services after updated Terms are posted means you accept the updated Terms.

31. Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles.

32. Dispute Resolution and Venue

Subject to any rights you may have under applicable consumer protection laws, any dispute arising from or relating to these Terms, the website, the services, an order, a digital download, or a physical product will be resolved in the courts located in Alberta, Canada.

Before starting legal proceedings, you agree to contact hello@it3dp.ca and attempt to resolve the dispute informally.

33. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

34. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

35. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms as part of a business sale, restructuring, merger, acquisition, or transfer of assets.

36. Entire Agreement

These Terms, together with the Privacy Policy and any checkout terms, order confirmations, refund terms, or service-specific terms presented to you, form the entire agreement between you and The Print Shop by iTech regarding the website and services.
